Książka ukazała się w nowej serii wydawniczej „Scripta Philosophiae Classicae”, obejmującej studia i komentarze z dziedziny filozofii realistycznej, a dotyczy podstaw racjonalności prawa stanowionego oraz filozoficznych źródeł współczesnego konwencjonalizmu prawa. Podstaw tych poszukuje się w zgodności prawa z naturą realnego bytu (osoby) i jego działania odczytanych przez rozum. W prawie, jak i w każdym racjonalnym wytworze wyróżnić można dwa aspekty: przedmiot i myśl o przedmiocie. W przypadku prawa aspekt przedmiotowy stanowi fakt prawa (ius), którym jest realna relacja wiążąca osoby ludzkie z dobrem wspólnym, zaś poznawcze ujęcie tej relacji i odczytanie jej treści stanowi norma (lex). Racjonalne prawo stanowione zakłada zatem obiektywny i racjonalny porządek realnej relacji międzyosobowej należnej z uwagi na dobro osoby.

In the Search of the Foundation of the Rationality of Law
in a series of "Scripta Philosophiae Classicae"

The book was published in the new series "Scripta Philosophiae Classicae", including studies and commentaries in the field of realistic philosophy, and concern basis of rationality of positive law and philosophical sources of contemporary conventionalism of law. These foundations are looking at the accordance between the law and the nature of real being (person) and its (his) activities read by the reason. In the positive law, as well as in every rational artifact, we can distinguish two aspects: the object and thinking about the object. In the case of law, substantive aspect is the fact of law (ius), which is a real relation binding the human person to the common good, and the cognitive approach of this relation and reading its content is the norm (lex). Rational positive law thus implies an objective and rational order of the real interpersonal relation due to the good of persons.
